Terms and Conditions 2025

Wallet size images are 3.5×2.5″ and come in sets of 4. All 4 wallet size images must come from one image

One pose comes with one digital image. Each pose is a single photography session that consists of a single portrait setup.

Digital images may be emailed out at the end of the day

If you do not have your digital images within two business days, please send us an email to santa@nickkringle.ca with the following information: 

a. The email you submitted

b. The mall you had the pictures taken 

c. A picture of your printed photo 

Terms and Conditions for Photos with Santa

  1. Reservations
  • Reservations are scheduled in coordination with walk-in mall patrons and may not take place at the exact scheduled time. You must still arrive at your reserved time, and we will make every effort to honour your reservation time promptly. Please note that wait times may vary, as we cannot anticipate the size of groups or the orders placed by patrons ahead of you.
  • On reservation days, walk-in patrons will be served only after all reservations and the reservation line have been accommodated.
  • Rescheduling may be accommodated subject to availability. Please submit your request by email to santahelp@nickkringle.ca.
  1. Photography
  • Professional photography services are included with purchase only, and patrons will receive digital copies of their images.
  • Patrons are not permitted to take their own photographs unless purchase is made.
  1. Photo Sessions
  • Each session during peak periods is limited to approximately 3–4 minutes to ensure all families have an opportunity to participate.
  • Retakes prior to printing are at the photographer’s discretion and are limited to a maximum of two.
  • Once images have been confirmed by the patron and prints have been produced, no further retakes will be permitted.
  • Patrons will have up to 2 minutes to make their photo selection.
  1. Payment
  • This is a paid event, payment must be completed onsite in line before pictures are taken. Someone will be at the event to help you.
  • Payment must be made before the time of the photo session.
  • There are no refunds, all purchases are final.
  1. Code of Conduct

Patrons are expected to conduct themselves respectfully at all times. Any disruptive behavior, as determined at the photographer’s discretion—including, but not limited to:

  • Use of foul, abusive, or inappropriate language
  • Aggressive or threatening conduct toward staff, patrons, or Santa
  • Refusal to follow staff or photographer instructions
  • Interfering with photography equipment or the session setup
  • Excessive noise or unruly behavior that disturbs others
  • Roughhousing, running, or unsafe conduct in the photo area
  • Disrespectful treatment of Santa, staff, or other families
    may result in the termination of the session. Refund requests may be submitted via email to santahelp@nickkringle.ca and will be processed at a later date.
  • Children must be supervised at all times.
  1. Liability
  • The mall and Santa’s photography team are not responsible for any injuries, accidents, or damages that may occur during the photo session.
    • By participating in the photo experience, patrons agree to release the mall and its staff from any related liability.
  1. Use and ownership of Images

By participating in the photo session, patrons acknowledge that all images produced remain the exclusive property of the mall and Santa’s photography team. Patrons grant the mall and Santa’s photography team the unrestricted right to use, reproduce, display, and distribute these images for promotional, marketing, or commercial purposes. This grant includes, without limitation, the waiver of any moral rights in accordance with the Copyright Act (Canada). Patrons who wish to opt out of the use of their image may submit a request, including a copy of the digital image, via email to santaoptout@nickkringle.ca

  1. Changes to Terms

The mall reserves the right to update or modify these terms and conditions at any time. Patrons will be notified of any significant changes. Questions about terms may be emailed to santahelp@nickkringle.ca

  1. Marketing Communications Consent
    By providing their email address and other contact information, the Participant expressly consents to receive future communications, including promotional emails, newsletters, and marketing materials. The Participant may withdraw this consent at any time by following the unsubscribe instructions included in any email communication and / or by opting out using this email santaoptout@nickkringle.ca
  2. One reservation per group.
